Terms of Service

These Terms govern your use of nasugn.com and any of our products. Each product may have additional terms specific to it (for example, Vigil's terms cover camera surveillance obligations, MatchReel's cover match footage). Where those additional terms exist, they apply on top of these.

1. Nasugn and its products

"Nasugn" refers to the company. "The service" refers to whichever of our products you're using. A product-specific terms page is linked from each product's marketing site.

2. Account registration

• You must provide a valid email address to create an account.
• Sign-in links are single-use and expire within minutes of being sent.
• You must be at least 18 years old.
• You're responsible for keeping your account secure.

3. Acceptable use

You agree to use our products only for lawful purposes. Across all products, you must not:

• Use the services for anything illegal in your jurisdiction.
• Attempt to reverse-engineer, disrupt, or gain unauthorised access to any of our systems or other tenants' data.
• Resell or sublicense our services without our written consent.

Product-specific restrictions apply. In particular: video surveillance (Vigil, MatchReel) has legal requirements around consent and notice that vary by jurisdiction. You're responsible for meeting them.

4. Payment and subscriptions

Each product has its own pricing. Payments are processed by Stripe. We don't store card details on our servers. Refunds are handled per each product's terms and where required by law.

5. Data and privacy

Your use of any of our products is also governed by our Privacy Policy, which is incorporated by reference.

You retain ownership of content you upload (video, documents, transactions). You grant Nasugn a limited licence to store and process that content solely to provide the service to you.

6. Service availability

We aim for high availability but don't guarantee 100% uptime. Planned maintenance may occur. We're not liable for losses arising from service interruptions.

We reserve the right to discontinue a product with 30 days' notice. If we do, we'll refund any prepaid unused portion pro-rata.

7. Intellectual property

Nasugn's names, logos, software, and marketing sites are our property. You may not use our trademarks without written consent.

8. Limitation of liability

To the maximum extent permitted by law, Nasugn's total liability to you for any claim arising from these Terms or your use of any of our products is limited to the amount you paid us for the affected product in the 3 months preceding the claim.

We aren't liable for indirect, incidental, consequential, or punitive damages, including loss of data, loss of profits, or breaches arising from your failure to secure your own credentials.

9. Indemnification

You agree to indemnify Nasugn against claims, damages, or expenses (including legal fees) arising from your use of any of our products, your breach of these Terms, or your violation of any third party's rights.

10. Termination

We may suspend or terminate your account immediately for breach of these Terms. You may close your account at any time by emailing support@nasugn.com. On termination, your personal data will be deleted within 30 days.

11. Governing law

These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria, Australia.

12. Changes

We may update these Terms from time to time. Material changes will be announced on the blog at least 14 days before taking effect.
