Terms of Service

These Terms of Service ("Terms") govern your use of the Nasugn Vigil service operated by Nasugn ("we", "us", "our"). By creating an account or using the service, you agree to these Terms.

1. The Service

Nasugn Vigil provides cloud-based camera streaming and recording services. You install a software agent on a device connected to your camera; that agent securely streams video to our cloud infrastructure, which you can then access from any browser.

2. Account Registration

• You must provide a valid email address to create an account.
• You are responsible for keeping your account secure. Sign-in links are single-use and expire after 15 minutes.
• You must be at least 18 years old to use the service.
• One person or legal entity may not maintain more than one free account.

3. Acceptable Use

You agree to use the service only for lawful purposes. You must not:

• Monitor people without their knowledge or consent where required by law.
• Use the service to store or transmit illegal content.
• Attempt to reverse-engineer, disrupt, or gain unauthorised access to the service or other tenants' data.
• Resell or sublicense the service without our written consent.
• Use the service in a way that violates any applicable privacy law.

You are solely responsible for ensuring your use of the service complies with all applicable laws in your jurisdiction, including any laws regarding video surveillance and recording of individuals.

4. Subscription and Payment

• Live streaming is available at no cost. Cloud recordings require an active paid subscription.
• Subscriptions are charged at $10 per camera per month, billed monthly via Stripe.
• Payments are non-refundable except where required by law.
• If a payment fails, we will retry the charge. Access to recordings may be suspended if payment remains outstanding after 7 days.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5. Data and Privacy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all video content captured by your cameras. You grant Nasugn a limited licence to store and transmit that content solely to provide the service to you.

6. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We may perform maintenance at any time. We are not liable for losses arising from service interruptions.

We reserve the right to modify or discontinue the service with 30 days' notice. If we discontinue the service, we will provide a pro-rata refund for any unused prepaid period.

7. Intellectual Property

The Nasugn name, logo, software, and website are owned by Nasugn. You may not use our trademarks without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Nasugn's total liability to you for any claim arising from these Terms or use of the service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of data, loss of profits, or security breaches resulting from your failure to secure access credentials.

9. Indemnification

You agree to indemnify Nasugn against any claims, damages, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third party's rights.

10. Termination

We may suspend or terminate your account immediately if you breach these Terms. You may close your account at any time by contacting us at support@nasugn.com. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria, Australia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
